STF forms majority to deny pardon to Maluf

The Federal Supreme Court (STF) formed a majority to deny a request by the defense of former deputy and former mayor of São Paulo, Paulo Maluf, for a pardon.

The trial takes place by the virtual plenary of the STF (voting method in which ministers register their votes in the system, without a session for individual reading). Ministers have until 11:59 pm this Friday (20) to register their votes in the STF system.

Minister Luís Roberto Barroso accompanied the rapporteur, Minister Edson Fachin, and voted against the request for the defense of the former deputy for the extinction of the penalty and fine.

Ministers Alexandre de Moraes, Gilmar Mendes, Cármen Lúcia and Rosa Weber also voted in this regard.

Fachin said that the reports presented by the defense alleging that Maluf has Alzheimer’s – and that they could give him the right to a pardon – should not be taken into account, because they were not made by official experts.

In addition, the minister also asks that “calculation of the remaining value of fines according to the legal criteria for monetary correction be carried out”.

Maluf was convicted, in 2017, by the 1st Panel of the STF, for the crime of money laundering, with a sentence of 7 years, 9 months and 10 days in prison, originally in a closed regime.
