The Minister of the Federal Supreme Court (STF), Alexandre de Moraes, asked that, in ten days, the National Institute of Social Security (INSS) present a plan for payments in retirements of the “review of life”. The deadline starts counting this Friday (3).
In a decision dated December 1, the STF authorized that part of INSS insured persons recalculate the value of their benefits, considering contributions prior to 1994 – when the government changed the rules for calculating benefits after carrying out a pension reform – , and the 2019 pension reform.
The INSS, however, asked the Supreme Court to suspend the progress of judicial proceedings on the matter, as it would not currently have the technical possibilities to recalculate retirements based on the new rule. The municipality estimated that the procedure should involve 51 million active and inactive benefits.
The minister considered the INSS’s arguments relevant regarding operational and technical difficulties, but highlighted that it is necessary to investigate the planning of the autarchy before granting any suspension. “It is unreasonable that, once the SUPREME guidelines have been established for the issue, the practical result of the judicial order remains without any forecast”, he wrote in the decision.
