STF grants habeas corpus to Bauermann so as not to testify at the Betting CPI

Summoned to testify at the Parliamentary Commission of Inquiry (CPI) on Sports Betting, in the Chamber of Deputies, Eduardo Bauermann, Santos defender, obtained a habeas corpus (HC) from the Federal Supreme Court (STF) and will not need to appear before the Commission.

Bauermann’s testimony was scheduled for this Tuesday (13), but the athlete had not been located by the CPI until Monday (12) night.

The HC, reported by Minister André Mendonça, of the STF, exempts the defender from participating in the Commission’s session. If the athlete chooses to attend, however, they are guaranteed the right not to answer certain questions, to have their lawyer present and not to sign terms stating that they undertake to speak the truth.

Bauermann was punished with a 12-game suspension by the STJD

On May 9, Bauermann was denounced by the Public Ministry of Goiás for being part of a game manipulation scheme. The Santos defender allegedly received more than R$ 800,000 from bettors, in exchange for being warned with yellow cards in matches against Avaí and Botafogo, valid for the 2022 Brazilian Championship.

The athlete, however, did not fulfill his part of the agreement, which motivated the rapporteur of the process, auditor of the Superior Court of Sports Justice (STJD) Adriane Hassen, to change the article of the complaint of 243 (who harms his club in exchange advantage) to 258 (acting contrary to sporting ethics).

Bauermann was handed a six-match suspension for each game the deal was made, making a total suspension of 12 games. At the moment, the defender is away from Santos, which is negotiating with Aytemiz Alanyaspor, a club in the first division of Turkish football.
