STF has 9 votes to make former deputy Roberto Jefferson defendant

The Federal Supreme Court (STF) already has 9 votes to transform former deputy Roberto Jefferson (PTB) into a defendant for crimes of homophobia, slander and incitement to the crime of damage to public property.

In addition, the ministers decided to send the case to the Federal Court in Brasília, since Jefferson does not have the prerogative of jurisdiction. All ministers have already spoken. There are 9 votes in favor of making Jefferson a defendant and 2 votes against.

The conclusion of the trial takes place at 23:59 this Friday (24). The analysis of the case takes place by the virtual plenary of the Supreme (a type of judgment in which ministers register their votes in the STF system, without a session for the individual reading of each vote).

Minister Alexandre de Moraes, rapporteur of the case, voted to receive the complaint presented by the Attorney General’s Office (PGR).

Ministers Gilmar Mendes, Edson Fachin, Luís Roberto Barroso, Dias Toffoli, Cármen Lúcia, Ricardo Lewandowski, Rosa Weber and Luiz Fux accompanied the rapporteur.

The two ministers appointed by Bolsonaro to the STF, Nunes Marques and André Mendonça, voted for the PGR’s complaint to be sent to the Federal Justice of the DF and analyzed there.

The PGR lists statements by the former deputy and states that he committed crimes under the Penal Code, the National Security Law and the law that defines crimes resulting from racial or color prejudice.

According to Moraes, Jefferson behaved “strongly against the Democratic State, having a brutal potential to harm democratic institutions, as they had ‘the intention of trying to prevent the free exercise of the Legislative Power’”.
