The Federal Supreme Court (STF) ruled unconstitutional rules in Rio Grande do Sul and Ceará that gave state prosecutors the right to carry firearms.
The action, proposed by the Attorney General of the Republic, Augusto Aras, was analyzed in the virtual plenary of the court until last Tuesday (8), and the minutes of the trial were published this Wednesday (16).
Aras argued that the rules violated the exclusive competence of the Union to legislate on the matter — thus, it was not up to the states to have autonomy for such recommendations.
The rapporteur of the action at the Supreme, Minister Cármen Lúcia, pointed out that questions about trade, acquisition, possession and possession of firearms, as well as ammunition, are topics of national interest and that affect public security.
“That’s why the normative treatment of such matters requires uniform and coherent legal discipline at the national level, to be edited, exclusively by the Union”, he said.
According to the minister, article 6 of the Disarmament Statute lists the categories that are excluded from the general rule that prohibits the carrying of weapons throughout the national territory, and among them are not state attorneys.
The minister was unanimously joined by the other ministers.
