STF must vote this Thursday on action on police lethality in Rio de Janeiro

The Supreme Federal Court (STF) is expected to reconsider, this Thursday (22) ADPF 635, which aims to reduce police lethality in operations in the favelas of Rio de Janeiro.

ADPF, acronym for Allegation of Non-Compliance with a Fundamental Precept, seeks to combat acts that disrespect the so-called fundamental precepts of the Constitution. The action was filed by the Brazilian Socialist Party (PSB), the Public Defender’s Office and civil society entities.

The Supreme ruled the ADPF last week, but voting on the Legal Framework for Sanitation occupied the entire agenda of the plenary. Direct Unconstitutionality Actions on the sanitation framework are also on the voting agenda.

Also this Thursday (02), the Favelas Committee organized by FAFERJ (Federation of Favelas Associations of the State of Rio de Janeiro), which has been in Brasília since Wednesday (01), will hold a series of meetings with members of the National Congress, and will be at the STF.

The objective of the Committee is to denounce the violence against the favela population and “to formulate possible solutions with the public authorities to protect life in the communities of Rio de Janeiro”.

The expectation is to demand concrete actions from the government to protect the lives of residents of these communities and reduce violence in police operations. Some of the group’s demands, such as the installation of cameras in police uniforms, are also in the ADPF, which will be voted on by the STF.

The ADPF trial started in May of this year, but was stalled after Minister Alexandre de Moraes asked to see the case. This same action was the one that, last year, determined the restriction of police operations in the state of Rio de Janeiro while the Covid-19 pandemic lasted.

In the initial action, the PSB requested the adoption of measures such as the formulation of a plan to reduce police lethality and to control human rights violations; the prohibition of the use of helicopters as a firing platform; the presence of ambulances and health teams in operations; protection against invasion of homes by community residents; the reduction of operations in school areas and health facilities; the installation of GPS and audio and video recording equipment in police officers’ uniforms and vehicles.

Since June 2020, when operations were restricted in the state, two major police actions, with a significant number of deaths, were carried out in Rio de Janeiro: the operation in the Jacarezinho favela, which started in May 2021 and left 28 people dead, and the operation in Complexo do Salgueiro, at the end of November, which left 10 people dead.
