STF overturns Bolsonaro’s veto that prevented fuel taxation by companies in the Manaus Free Trade Zone

The Federal Supreme Court (STF) decided, by 7 votes to 4, to overturn President Jair Bolsonaro’s (PL) veto against the ban on companies in the Manaus Free Zone from importing oil and derivatives with exemption from PIS and Cofins.

The trial takes place in the virtual plenary of the STF. In theory, ministers have until the 20th to register their votes in the Supreme Court system. Until then, they can change their vote, for example.

The rapporteur of the case, Minister Cármen Lúcia, voted against the action. Ministers Dias Toffoli, André Mendonça and Nunes Marques accompanied the rapporteur.

Most, however, followed the understanding of Minister Luís Roberto Barroso, who was in favor of the action. The ministers Gilmar Mendes, Edson Fachin, Ricardo Lewandowski, Rosa Weber, Luiz Fux and Alexandre de Moraes voted in this regard.

Barroso also proposed the following judgment thesis: “the veto power provided for in art. 66, § 1, of the Constitution cannot be exercised after the 15-day constitutional period has elapsed”.

The discussion that is in the STF because of a law sanctioned by Bolsonaro in July 2021. On the opportunity, Bolsonaro sanctioned the version approved by Congress in the morning, ending the tax exemption. Later, however, he republished the text with a veto, in a movement of pressure from the bench of congressmen from Amazonas.
