STF resumes judgment of action on police operations in RJ this Wednesday (2)

The Federal Supreme Court (STF) resumes, this Wednesday (2), the analysis of the action on police operations in Rio de Janeiro during the Covid-19 pandemic.

The score is 1-1 at the moment. The rapporteur of the case, Minister Edson Fachin, was in favor of the appeal presented and for the adoption of measures to reduce police lethality. Minister Alexandre de Moraes partially disagreed.

The trial began in virtual plenary in May last year, but was interrupted by a request for a view from Moraes. The consideration was resumed in the physical plenary on December 15th. However, she was suspended by the President of the Supreme Court, Luiz Fux.

Fachin, in his opinion, adopted measures to reduce the lethality of the police in the actions. The magistrate ordered the installation of monitoring systems by cameras and GPS in the uniforms of security agents.

“Therefore, when installing GPS equipment and recording systems, I complement the vote, in order to determine that priority be given to the installation of this equipment in the vehicles and uniforms of agents employed in policing and in operations in slums and poor communities. ”, declared Fachin.

For the magistrate, corrupt police officers who are part of militias “cannot have a place in the rule of law”. “Whoever thinks they have the power to take a life imagine that they also have the power not to take it, and with that they start to negotiate their lives. Whoever carries out an autonomous operation is not a policeman, he is a militiaman, and a militiaman cannot have a place in the rule of law, much less in the police”, said Fachin.

Moraes, in his vote, agreed with the rapporteur on some points, such as the establishment of a plan to reduce police lethality, the need to investigate incidents in which the victims are children and adolescents and rules for house searches.

However, it differed on the suspension of the secrecy of all protocols of action of the security forces of Rio de Janeiro and on the analysis by the Federal Public Ministry (MPF) of the allegations of non-compliance with the decision handed down by the STF.

For the minister, the high death rates of police officers “should be better investigated, both by the police themselves and by the Public Ministry”.

“None of the great western democracies have such a high rate of number of police officers killed in operations,” he added.
