The Federal Supreme Court (STF) begins to analyze from 00:00 on Tuesday (25) over 200 complaints against those involved in the acts of January 8. If the ministers accept the denunciations, the accused become defendants and start to respond to criminal proceedings in the Court.
The analysis will be carried out in the virtual plenary of the Supreme Court, in a session that ends on May 2. In the format, there is no debate between ministers. Magistrates cast their votes in an electronic system.
100 complaints were put on the agenda against suspects suspected of being the executors of the attacks, which culminated in the invasion of the headquarters of the Three Powers, in Brasília.
The other 100 complaints that will be analyzed were filed against those investigated in the investigation that targets the instigators of the acts. The accused were arrested on January 9, in front of the Army Headquarters, in Brasília.
The complaints were made by the Attorney General’s Office (PGR).
The Supreme Court began last week to analyze the first accusations of the PGR. On Wednesday (19), the plenary of the Court formed a majority to receive 100 complaints and make defendants defendants.
The following magistrates voted according to the understanding of the rapporteur, Minister Alexandre de Moraes: Dias Toffoli, Edson Fachin, Cármen Lúcia, Gilmar Mendes, Roberto Barroso, Luiz Fux and Rosa Weber. The votes of André Mendonça and Nunes Marques are still missing. They must deposit their votes until 23:59 this Monday (24).
In the case of the executors, the complaints point to the commission of crimes of armed criminal association, violent abolition of the Democratic State of Law (coup d’état), qualified damage against the Union’s property and deterioration of listed property.
Those who are investigated as inciters may respond for incitement equivalent to the animosity of the Armed Forces against the Constitutional Powers and criminal association.
Upon acceptance of the complaint, criminal proceedings will begin. In this phase, the collection of evidence and testimonies of defense and prosecution witnesses takes place. Only after that the Justice will decide whether to condemn or acquit those involved. There is no set deadline for this.
In all, the PGR has already denounced 1,390 people in connection with the January 8 acts.
Manifestations of lawyers and public defenders to the STF have requested the rejection of complaints related to the acts of January 8, as they understand that the accusations presented to the Court are generic and do not indicate concrete actions that constitute a crime.
The defendants’ defenses also argue that the STF does not have the competence to prosecute and judge those involved.
