STJ denies habeas corpus to director of school suspected of mistreatment in São Paulo

In a session held this Tuesday (25), the Sixth Panel of the Superior Court of Justice (STJ) denied the request for release of the defense of Fernanda Carolina Rossi Serme, director of a daycare investigated for torture and ill-treatment of children in the east of the country. Sao Paulo City.

Fernanda’s partner and sister, Roberta Serme, has also been in preventive detention since April this year.

Fernanda Serme’s lawyer, Felipe Cassimiro, argued that the defendant is imprisoned due to the “public outcry” and the “proportion” that took the case, and stated that they should not interfere in the judgment of the judiciary on the matter.

Felipe called the population’s revolt “understandable, since they were videos with children supposedly tied up, in supposedly unhealthy environments”.

“I demonstrate that it was a preventive detention with the aim of calming the population’s spirits since the patient, even before these videos were broadcast in Jornal Nacional, for example, responded to the entire investigation in freedom”, said the lawyer.

The rapporteur of the action in the STJ, Minister Rogério Schietti Cruz, however, voted for the maintenance of the preventive detention of the director of the school.

In the reading of his vote, accompanied by all the other members of the Class, Rogério brought to light the alleged abuses suffered by the children, including the death of a 4-month-old baby, at the time enrolled in the day care center.

The minister also cited threats by the defendants against witnesses to the abuses.

“The imposition of excessive, unnecessary and long-term physical and mental suffering on young children, to the point of causing danger to the babies’ own lives, highlights the accentuated danger of the defendant and the harmful potential of her attitudes, suitable factors to support the measure. more burdensome that was imposed on him in view of the effective risk to public order”, said the rapporteur of the case.

In addition to the sisters, a school employee, Solange da Silva Hernandez, is also accused of mistreatment for punishing students who cried or refused to eat. Solange responds in freedom, and, like the sisters Fernanda and Roberta, denies all the accusations.
