The Sixth Class of the Superior Court of Justice (STJ) denied, this Tuesday (7), a request to stop a criminal action that judges responsibility for the fire that hit, in 2019, the training place of Flamengo’s base categories. , known as the Vulture’s Nest.
Eleven defendants respond in court for the death of ten players from Flamengo’s base who were sleeping in the accommodation at the time of the fire. Three other teenagers were seriously injured.
The request for annulment of the criminal proceedings was filed by the defense of the former director of Media at Clube de Regatas Flamengo, Antônio Marcio Garotti, denounced for alleged responsibility in the fire.
In a note, the STJ reported that, by majority vote, the collegiate understood that the complaint presented by the Public Ministry of Rio de Janeiro (MPRJ) has “concrete grounds for criminal imputation”. For the ministers of the Court, prosecutors were able to gather evidence that would indicate the former director’s relationship with the tragedy.
Lawyer Antônio Pitombo, who represents Marcio Garotti, stated that two elements used by the Justice to open the criminal action are not included in the MP’s complaint: “first, the type of conduct cited by the judge is not present in the complaint, and second, the Justice says that he (Marcio) should resign when he is aware of the facts, which is also not included in the complaint”.
The lawyer also said that he must appeal this Tuesday’s decision (7) to the Federal Supreme Court (STF).

The defendants in the case were charged with arson, when there is no intention of causing fire or endangering the physical integrity of other people.
In November 2021, the Justice of Rio decided to dismember the process after the acquittal of monitor Marcus Vinícius Medeiros, responsible for guarding the container where the athletes were. Justice also rejected the MP’s complaint against the club’s former engineer, Luiz Felipe Pondé, and a former Flamengo grassroots director, Carlos Noval.
The Public Ministry appealed and a new process was opened for the trial of these three defendants. So far, there is still no scheduled hearing.
