The Superior Court of Justice (STJ) postponed until May the choice of the list that will be presented to President Jair Bolsonaro with indications to fill the two vacancies of minister in the Court.
In a meeting held this Tuesday (1), the ministers decided to extend the virtual work until March 31 because of the advance of the Covid-19 pandemic in the country, especially in the Federal District.
In addition, the choice of nominations for the STJ was left for May 12. Before, the definition was scheduled to take place in February.
The postponement took place because the ministers intend to elect the list only in face-to-face sessions, and not by videoconference.
Because of this, the election was postponed last year, when the Court operated remotely.
In October last year, the Plenary of the STJ unanimously approved a proposal by the current president of the Court, Minister Humberto Martins, for the session for the formation of the list to be held on February 23, in person.
How is the nomination to the STJ made?
Unlike the Federal Supreme Court (STF), in which the choice rests exclusively with the President of the Republic, vacancies in the STJ are filled according to the prior choice of the Justices of the Court.
Vacancies are also distributed according to the ministers’ area of ​​activity. The two current vacancies are indications of judges of the Federal Regional Courts and were opened with the retirement of ministers Napoleão Nunes Maia Filho and Nefi Cordeiro.
Nunes Maia retired by age in December 2020, after 13 years working at the STJ. Shortly after, in March 2021, after seven years in the Court, Minister Nefi Cordeiro asked to retire.
Normally, STJ ministers choose three names from the defined area and send them to the President of the Republic, who has to choose one of them for the nomination. In this case, as there are two seats destined for the TRF, the STJ will define a list with four names and Bolsonaro will have to choose two of the nominees.
