STJ gives the right to freedom to Monique Medeiros, mother of the boy Henry Borel

Minister João Otávio de Noronha, of the Superior Court of Justice (STJ), granted a request for habeas corpus and granted Monique Medeiros the right to respond to the prosecution process for the death of her son, Henry Borel, at liberty. The decision was signed this Friday (26).

Monique is accused of the death of the 4-year-old boy in March 2021, along with her ex-boyfriend, doctor and former councilor Jairo Souza Santos Junior, Dr. Jairinho.

“I grant the ex officio order to revoke the patient’s preventive detention, ensuring the right to respond to the process in freedom, without prejudice to a new decree of
precautionary measure of a personal nature based on contemporary reasons”, said the minister in the decision.

Monique had been under house arrest since the beginning of April, but in June, by order of the Justice, she returned to the Santo Expedito Penal Institute, in the Gericinó Complex, in Bangu, in the West Zone of Rio.

The Rio de Janeiro Court of Justice (TJ-RJ) re-established the defendant’s preventive detention in June, reforming the decision of the first degree court that, in April, had replaced the measure with electronic monitoring.
