STJ prohibits municipality from spending R$ 700 thousand on shows by Bruno and Marrone and Sorriso Maroto

The president of the Superior Court of Justice, Minister Humberto Martins, prohibited the performance of shows by the country duo Bruno and Marrone and the pagode band Sorriso Maroto scheduled for the 17th Festa do Cacau, which takes place until next Saturday (18) in Urucurituba, municipality of 24 thousand inhabitants located 218 km from Manaus.

The minister accepted a request made by the Public Ministry of Amazonas, which alleged a disproportion between the municipality’s financial condition and the amounts to be spent on the shows: R$500,000 for the duo and R$200,000 for the pagode band.

“The performance of the shows will cause damage to the local administrative public order, given the precariousness of the services provided to the population and the very high cost of the shows. Therefore, in terms of procedural interest, the suspension measure is entirely appropriate,” said the minister.

According to the minister, the photos presented by the MP in the public civil action prove that there are problems in the municipality.

“There are unfinished schools. The city’s streets are in terrible condition, including the main street, in front of the Amazon River, which has been eroded for more than 30 days without repairs. Only 23% of the population has sewage treatment.

The minister also recalled the importance and relevance of culture in the life of the local population.

“But the lack of basic services in such disproportion, as in the case of the case, causes an objective imbalance that makes the expenditure undue and justified the caution sought by the MP”, he said.

On June 5, Humberto Martins also suspended the decision of a judge on duty at the Bahia Court of Justice (TJBA), who had authorized the performance of the concerts scheduled for the Banana Festival, in the municipality of Teolândia. The program featured a concert by singer Gusttavo Lima.

In the request, the MP-BA questioned the expenses of the event, calculated at about R$ 2 million, an amount greater than 40% of health spending in the city throughout 2021.

The defense of the event was sought, but has not yet manifested.
