The Superior Court of Justice (STJ) resumes this Wednesday (2) the process of former player Robinho, sentenced in Italy, ultimately, to nine years in prison for the charge of rape against a young woman of Albanian origin in a nightclub. , in 2013.
The Italian court asked Robinho, who lives in Brazil, to serve his sentence in the country, taking into account that Brazilian citizens cannot be extradited.
In February of this year, the Federal Supreme Court (STF) agreed to transfer the sentence. Two months later, the Special Court of the Superior Court of Justice (STJ) began analyzing the defense appeal of former player Robinho against the monocratic decision of the rapporteur, Minister Francisco Falcão.
The minister denied the player’s defense request for the Italian government to send a full and translated copy of the process that led to the athlete’s conviction.
In the analysis of the internal appeal of the player’s defense against the rapporteur’s decision, the Special Court analyzes the possibility of ratification of the Italian sentence and, if so, the transfer of the execution of the player’s sentence to Brazil.
According to the STJ, Robinho’s defense believes that the ratification of the sentence only with the documents attached to the file by Italy does not guarantee respect for Brazilian legislation, as it would not be possible to verify whether the due process of law was observed abroad.
The process will have the presentation of the vote-view of the minister João Otávio de Noronha from 14h.

At first, the former player denies that he got involved with the girl. Afterwards, he assumes that he had oral sex, but with the victim’s consent. Ultimately, he assumes he had penetrative sex.
“Yeah, I ate, man! Because she wanted to. Where (sic) did I force the mine? I ate mine, she made me a pacifier and then I left”, says Robinho to Ricardo Falco.
