The Superior Military Court (STM) unanimously denied, this Monday morning (1st), the request for habeas corpus for Jesser Marques Fidelix, member of the Red Command, involved in the theft of machine guns from an Army barracks in Barueri, which occurred in September last year.
In addition to Fidelix, two other military personnel and a civilian, allegedly another member of the criminal faction, remain in prison awaiting the outcome of the case. In April of this year, the Military Court had already denied the release of the military personnel involved. New analyses of the cases should take place in the second half of this year.
Two other military personnel, a lieutenant colonel and a lieutenant, indicted for indirect participation in the crime, are responding to the case at liberty. Four civilians, accused of negotiating the weapons, have not yet been located.
Jesser Marques Fidelix was arrested last April in a luxury condominium in Santana de ParnaÃba, in Greater São Paulo, during the execution of nine search and seizure warrants in Rio de Janeiro and São Paulo.
According to the Rio de Janeiro police, Fidelix is ​​a supplier of weapons and drugs to criminal organizations in Rio de Janeiro, especially Comando Vermelho (CV).
Born in EspÃrito Santo, Fidelix has six addresses in Rio and São Paulo, but declared to the Federal Military Court the address of a small beverage distributor in the capital of Rio de Janeiro, which has been deactivated since 2023.
Request for freedom
Fidelix’s defense filed a habeas corpus petition against the preventive detention ordered by the judge of the 2nd Military Court of São Paulo. The defendant is facing criminal charges for illegal firearms trade in the Military Court.
Fidelix’s lawyer argued that the information from the judicial police is not related to the crime being processed in the Military Court, is not criminally relevant and does not justify preventive detention.
However, the minister who assessed the case highlighted that the decision on the arrest presented concrete data indicating a risk to public order due to the possible conduct of the accused.
Furthermore, it was mentioned that Fidelix has financial transactions linked to criminals in the illegal firearms market, including financial transfers between him and the sister of a known international arms trafficker.
