In Italy the surrogacy it’s already a crime. If the Brothers of Italy bill passed, it would become universal crime: pregnancy for others would be considered a crime in our country even if it occurred abroad. The proposal is signed by the undersecretary and senator Isabella Rauti and the group leader of the senators Lucio Malan.
The bill presented to the Senate is similar in text to that presented to the Chamber in the last legislature by Giorgia Meloni. The bill provides for the modification of article 12 of the law of 19 February 2004, n.40concerning the prosecution of the crime of surrogacy committed abroad by an Italian citizen.
Currently, those who undertake the path of surrogacy in Italy can be prosecuted: the penalty for those who violate the law provides for imprisonment from 3 months to 2 years and a fine from 600,000 up to one million euros. The Rauti-Malan bill states that the penalties apply even if the offense is committed abroad.
There are countries where gestation for others is allowed. From India to the United States passing through Ukraine, where, however, the conflict has stopped the travel of those who choose surrogate motherhood. The bill already presented to the Chamber speaks of the «dissemination of the so-called procreative tourismi.e. the phenomenon whereby Italian couples who cannot have children make use of the technique of surrogacy in a foreign country where it is permitted».
The signatories of the bill say that «the use of these practices is soaring and surrogacy is becoming a real business which, just to give an example, is worth over 2 billion dollars a year in India. In India, volunteers who enter the legal circuit of surrogacy clinics earn between 8,000 and 9,000 dollars per gestation, a figure that corresponds to ten years of work by an unskilled worker». With 25-30 thousand dollars surrogacy is possible in India, the costs double in the United States of America.
