Suspected of killing architect was loose after police error

The tragic death of architect Jefferson Dias Aguiar, 38, occurred on the afternoon of Tuesday (1st) in Butantã, west of Sao Paulo, happened after the suspect, 20-year-old Hugo dos Santos Araújo had benefited from a Habeas Corpus granted by the Superior Court of Justice (STJ) in August 2023 after a personal search considered illegal due to the absence of founded suspicion.

Jefferson Dias Aguiar was fatally hit by three shots after witnessing a woman’s robbery on Judge Armando Fairbanks Street. According to the Military Police, two individuals on a motorcycle were conducting theft in the region. Seeing the scene, Jefferson reacted throwing his car against the criminals’ motorcycle, knocking over one of them, later identified as Hugo dos Santos Araújo .

After being run over, the architect descended from the vehicle and tried to stop Hugo. At this point, it was hit by three shots, one of them in the back region, near the back of the neck. Jefferson was taken very seriously to the University Hospital, but could not resist the injuries.

The criminals abandoned the motorcycle on the spot, which was stolen, and fled on foot. Police identified the two suspects as Hugo dos Santos Araújo, appointed as the author of the shooting, and 20 -year -old Kawã Felipe Celestino, the motorcycle rider who would have giving Hugo.

Freedom after police error

In August 2023, Hugo dos Santos Araújo had benefited from a decision of the STJ who granted habeas corpus and determined the locking of a criminal action against him for major theft and extortion through kidnapping. The STJ’s decision considered that the personal search that led to Hugo’s arrest in that case was illegal, as it was based only on “suspicious attitude” and escapes when seeing the police, without the presentation of founded reasons. The STJ understood that such elements do not meet the “founded suspicion” requirement provided for in the Criminal Procedure Code for personal search.

This sequence of events rekindles the discussion on the impacts of judicial decisions that nullify evidence obtained in an illicit manner and the need to improve police practices to avoid illegalities that can contribute even more serious crimes in the future.

Hugo dos Santos Araújo surrendered to the police on the morning of Friday (4). Kawã Felipe Celestino continues to be sought. The Secretariat of Public Security (SSP) reported that the case of the death of the architect is being investigated as a murder by the State Department of Criminal Investigations (Deic).
