The competition for the Commander of the Labor Inspectorate was announced

Another step towards the transformation of SEPE into an Independent Labor Inspection Authority in the coming months is the announcement of the competition for the Commander of the Labor Inspectorate that follows the placement of the five-member Board of Directors at the end of 2021.

The deadline for applications expires in 15 working days (February 9), as announced today by the Ministry of Labor and Social Affairs.

The Commander of the Labor Inspectorate exercises all the responsibilities of the authority provided in Law 4808/2021 for Labor Protection, except those that are explicitly defined as exercised by the Board of Directors.

Indicatively, among others:

– Issues and amends the Organization and the Internal Regulations of the Labor Inspectorate and describes the jobs of its Services, through the preparation of job profiles

– Recommends to the Board of Directors on all matters within its competence

– Formulates and updates the long-term strategic planning of the Labor Inspectorate. It also prepares and reviews, if necessary, the Authority’s annual business plan

– Suggests to the Minister of Labor and Social Affairs legislative regulations on issues that fall within his responsibilities

– Selects and appoints the heads of the organizational units of each level of the Labor Inspectorate

– Determines the internal structure of the Labor Inspectorate Services and their local and substantive competence

– Exercises any other existing, at the time of the entry into force of the Labor Inspectorate, competence of the Inspector General of Labor

Upon taking up his duties, the Governor signs a performance contract with the Minister of Labor and Social Affairs which sets out his obligations and the qualitative and quantitative objectives to be achieved during his term of office, as well as on an annual basis.

Then, the Governor with his decision (published in the Official Gazette) issues the Organization of the Labor Inspectorate, which will describe the structure of the services of the Authority, their responsibilities, etc. and the Internal Rules of Operation

After the issuance of the Organization, the Minister of Labor will issue a Certificate of Activity for the commencement of the operation of the Labor Inspectorate. From the beginning of its operation, the Labor Inspectorate becomes the universal successor of SEPE.

Until the beginning of the operation of the Labor Inspectorate, its responsibilities are exercised by the SEPE, which continues to carry out intensive checks for the observance of the labor legislation, the rules of hygiene and safety.

The establishment of the Labor Inspectorate, which will have operational independence and administrative and financial autonomy, is one of the main sections introduced by the Law on Labor Protection. The aim is to carry out its work without political controls and interventions and to upgrade its crucial role in monitoring the implementation of labor law, including working conditions and conditions, hours, wages, health and safety, the implementation of collective labor agreements, insurance coverage of employees, etc.

“With the completion of the process for the appointment of the Governor of the new Independent Administrative Authority of Labor Inspection, another step is taken to start a new era for the observance of the legislative and regulatory framework in the labor market”, says the Minister of Labor and Social Affairs, Kostis Hatzidakis and adds:

“Together with the Digital Work Card, the new Authority will be important weapons in the fight against undeclared and undeclared work. In particular, the Labor Inspectorate, as it will start operating in the coming months, will operate according to the standards of AADE and the National Authority. Transparency, with much more guarantees of impartiality and objectivity, and will be a key tool for adhering to the rules of both working hours and overtime, as well as health and safety at work. which the government invests “.

The process for selecting the Commander

According to the invitation, the interested parties must have a university degree or diploma, ten years of professional experience related to the responsibilities of the Labor Inspectorate, objects and administrative experience in positions of responsibility in the private or public sector and have an excellent knowledge of a foreign language. Additional qualifications that are objectively graded with points include the possession of a doctoral / postgraduate degree, good knowledge of a second foreign language, previous service in a position of responsibility corresponding to senior managers in the private sector or general managers in the public sector, etc.

Interested parties are invited to submit applications electronically and an accompanying file within 15 working days. The first selection of candidates for the positions – based on their qualifications – will be done by an independent Committee, which submits to the Board of Directors the list of the four most dominant candidates. The Board of Directors ranks the two of the four most prominent candidates in order of priority and submits a proposal to the Minister of Labor and Social Affairs, who selects one of the two and proposes him for approval to the Parliamentary Institutions and Transparency Committee.

The appointment of the Governor follows with a reasoned decision of the Minister of Labor and Social Affairs, for a five-year term that can be renewed only once by decision of the Minister, following the consent of the Labor Inspectorate, with a majority of 2/3 of all its members.
