The Consell trusts 100% of the wind aid to Els Ports in exchange for assuming the legal cost with the successful bidder

The municipalities that make up the Els Ports region in the province of Castellón attend the end of the year 2020 with a clear claim regarding the wind farms located in their territories: to demand from the Generalitat Valenciana -more specifically, to the Valencian Institute of Business Competitiveness, Ivace- not keep 10 percent of compensation which correspond to them for the visual and environmental impact of these parks. This is a request that all the municipalities of the region that make up the calls zonas Z-1, Z-2 y Z-3 in the province of Castellón within the Wind Plan of the Valencian Community.

The Ivace annually compensates the municipalities with an economic amount that fluctuates but that, year after year, is not granted one hundred percent. The institute, dependent on the Conselleria de Economia, keeps 10 percent of said compensation because it must assume certain expenses. Among them, as confirmed by the mayor of Forcall and an expert in the processing of requests to the Ivace in this regard, Santi PÃ © rez, the costs derived from the continuous contentious appeals presented by the company awarded the parks in Els Ports to the Ivace resolutions. Â «Year to year, from the Ivace they transfer us that the company presents resources at the amount that the Ivace decides that it must pay. All this, although the resources do not prosper, causes that one has to go to court, pay some lawyers … So, that 10 percent is used in part to cover all those expenses, “explains the mayor of Forcall.

Thus, this year, before the pandemic broke out, the Ivace left a proposal on the ‘table’ of the Els Ports Commonwealth -Pà © rez met with the president of the organization, Blai Peà ± arroya, with the Director of the Ivace, Julia Company-.  «They made us the proposal that if we wanted to fully benefit from all the aids that are part of the compensation plan, they would agree, but as long as we assume the entire management of these aids, including the fact of making in the face of disputes », says Pà © rez.

That is to say, The Ivace ‘invited’ the Els Ports region to assume the judicial process derived from the contentious proceedings presented by the successful bidder if they wish to obtain the total of the aid. Somehow, this ‘invitation’ hides a paradox: the region, through the Commonwealth, would be doomed to disburse more budget to benefit from the aid that corresponds to it by right.

And it is that Pà © rez recognizes that  «we do not have the financial and material means necessary for this in the Commonwealth». TO”It’s a proposal on which we have not yet decided definitively and we are going to study it, It is clear, but the truth is that it would be difficult for us to take on all that management that involves going to court, hiring lawyers, etc. », indicates Pà © rez who, yes, highlights that « the positive thing would be that we We would benefit from 100% of the compensation aid, something we have been demanding for a long time.

1.1 MILLION FOR THE COUNTY OF THE PORTS

For the next exercise, the VAT includes 1.3 million euros for the municipalities of the region of Els Ports that are part of said plan -all those in the territory, except Vallibona, Herbà © s and Castell de Cabres-. Of those 1.3 million, finally, the municipalities would distribute 1.1 million, after keeping the Ivace with the mentioned 10 percent.

Other municipalities consulted, such as the City Council of Villores, consider that  «getting the total compensation would be very good for small towns, even more so in these times of crisis», indicates its mayor, Iván GuimerÃ, in relation to the coronavirus pandemic.

PÃ © rez adds that in the Commonwealth there are administrative profiles, a part-time secretary, Social Services technicians and tourism experts, but not profiles that could assume everything derived from the disputes presented year to year. ± or the successful bidder for these wind farms.

Although the mayor of Forcall recognizes the flexibility of the Ivace, he doubts the possibility that the Commonwealth has the capacity to face the judicial pulse in exchange for keeping all the aid.

By municipalities, this year 2020, Forcall will correspond to 90,000 euros; in Morella, 80,317 euros; in Palanques, 98,400; in Olocau del Rey, 88,204 euros; to Todolella, 92,000 euros; in Ares 80,317; in Castellfort, 80,317; in Cinctorres, also 80,317 euros; in Portell de Morella, 84,397 euros; to La Mata, 84,256 euros and to Zorita, 85,267 euros. Also, the Commonwealth would take 144,114 euros of which part goes to municipalities that are part of the region but that do not fall within the wind plan -mentioned above-, for a matter of solidarity and agreed between all city councils, as well as current expenses and promoting tourism.

It should be taken into account that in the event that a city council does not justify the total aid received, it loses the amount affected and this goes back to the Ivace fund – so to speak, to the remnants of the plan.

it is urgent to allocate aid to current expenses

The municipalities affected by the installation of wind farms, among them, those in the Els Ports region -zones Z-1, Z-2 and Z-3- also request the Valencian Institute of Business Competitiveness, Ivace, to be able to allocate the aid they receive for current expenses. Currently, the compensation that each town receives must be allocated mostly to works and investments. Only 10 percent of the amount can be focused on meeting current expenses of a municipality. This requirement puzzles the affected peoples, who consider that the percentage should be increased or the municipalities should be given greater freedom.

This is the case of small municipalities such as Villores or Forcall, which may not consider large investments but do have current spending needs, especially in times of crisis. The mayor of Forcall, Santi PÃ © rez, recalls that plans such as the 135 of the Provincial Council or the Cooperation Fund contemplate aid for the current expenses of the municipalities but those affected insist that wind aid should also be used for this. On the other hand, PÃ © rez indicates that the consistories signed an agreement in which it was said that those municipalities that did not carry out the works within a determined, they would be ‘penalized’ by losing the aid to return to the Ivace fund and, again, the ‘punishment’ of keeping 10% was applied.
