The European Parliament is taking legal action against the Commission over Poland

The President of the European Parliament David Sassoli requested today from his legal services European Parliament to take legal action against her European Commission for not activating the conditionality mechanism in issue of Poland.

The conditionality regulation, which provides for suspension of Community funds to a country that does not respect the rules of the rule of law, was adopted in December 2020.

President Sassoli’s letter to Parliament’s legal services follows voting to Parliament’s Committee on Legal Affairs, which recommended that the action be brought before the Court of Justice.

The appeal was also recommended by the majority of them leaders of political groups in the European Parliament, during today’s Conference of Presidents, according to the RES EIA.

In his letter, President Sassoli made it clear that the European Parliament would withdraw this legal procedure if the Commission shall take the necessary measures.

“EU Member States violating the rule of law must not receive European funds. Last year, the European Parliament fought hard for a mechanism to ensure this. However, so far the European Commission has been reluctant to activate it “, said Sassoli after the meeting of the leaders of the political groups in the Parliament.

“The EU is a community based on the principles of democracy and the rule of law. If they are threatened in one Member State, the EU should to act to protect them. “I therefore asked our legal services to file a lawsuit against the Commission to ensure that EU rules are applied correctly.”
