“Starred” as a baby at the age of four months, on the cover of Nevermind’s album Nirvana, which at that time is said to have taken off the band’s popularity. He also notes that their parents never officially gave permission to use his nude photo on the cover of Nirvana and that they had been promised that the child’s genitals would be covered with a sticker.
In addition, according to the complaint filed in the federal court of Los Angeles, Elden claims that “his identity and legal name were forever connected with the commercial sexual exploitation that he experienced as a minor and which is distributed and sold worldwide to this day.”
The text of the lawsuit also states that the defendants “knowingly produced, possessed and advertised commercial child pornography depicting Spencer and that they knowingly obtained financial benefits through it”.
Spencer Elden also complains that “to ensure that the cover would provoke an immediate sexual reaction in the viewer, photographer Kirk Wendl caused Spencer to vomit before photographing him underwater in poses that accentuated his exposed works.”
The 30-year-old claims that the defendants used child pornography depicting him as the main person to promote their album, that he has caused permanent damage of an emotional, psychological and financial nature, and the consequences follow him throughout his life.
Elden is seeking $ 150,000 in damages from each of the 17 defendants, or unspecified damages to be determined at trial.
Note that tNirvana’s Nevermind was released in September 1991 and in a few days it will celebrate its 30th anniversary. The album has sold over 30 million copies worldwide, and the cover is considered one of the most recognizable covers of all time.
