The SKAG-Jumbo controversy in Arios Pagos

By George Lampiris

The notebook production company, Th. Skagias SA, is preparing to file an appeal against the decision of the Athens Court of Appeals, which essentially came to ratify a previous decision of the Athens Multi-Member Court of First Instance. – SKAG. The company had filed a lawsuit against Jumbo for copying designs from notebooks it produces.

As Theodoros Skagias, CFO of SKAG, Theodoros Skagias, stated in Capital.gr, on the sidelines of a meeting of the members of the HELLA-DIKA MAS initiative, in which SKAG participates, “Jumbo was our biggest customer until the moment we filed a lawsuit against reflecting 10% of our turnover (indicatively SKAG’s turnover was 8,764,000 in 2021) ”.

Skagias: More than a decade of copying

According to Mr. Skagias, that plan was created by SKAG and Jumbo had it on its shelves, in turn Apostolos Vakakis’s company had it at the same time in a similar design made in China. “We spent more than a decade copying our designs, with our own tolerance as Jumbo brought turnover to our business. However, there came a time when we found on our shelves specific ‘University’ themed notebooks, which is our brand “, explains Mr. Skagias.

According to him, Jumbo had imported significantly large quantities of this notebook from China, marked ‘University’, and despite the request of the people of SKAG to remove it from its shelves, this did not happen. “Jumbo refused to withdraw the product, even replying that after disposing of all the stocks it had, then it would stop selling the specific notebooks. It was exactly the time when we proceeded to file a lawsuit against Jumbo,” he said. businessman.

In the lawsuit filed by SKAG, it demanded a sum of 2 million euros in votes against and 2 million euros in identification as compensation.

The decision of the Multi-Member Court of First Instance justified SKAG

Following all the above, the first instance decision of the competent Multi-Member Court of First Instance of Athens justified SKAG for its appeal – at least as far as the moral part of the case is concerned, setting a compensation of 6,815 euros. The specific amount was judged by SKAG as not satisfying its claims, so it then appealed to the Athens Court of Appeals, which with its decision a few days ago upheld the decision and the amount of 6,815 euros awarded by the Court of First Instance. . It should be noted that Jumbo, for its part, had appealed to the Athens Court of Appeals, in order to challenge the first instance decision.

The next step, according to Theodoros Skagias for the company SKAG, is to appeal to the Supreme Court, something that is expected to happen in the coming days, claiming compensation in excess of 6,815. If this step is deemed ineffective, the company now intends to appeal to the European courts, as he points out.
