The court considers a complaint filed in 2023 by a Spanish businessman calling himself “JL”. The plaintiff claims that in 2021 he introduced 67,550 euros (about $ 70,350) on the platform, but never gained access to these funds. After two -year attempts to return his money, the man resorted to a lawsuit, accusing the exchange of illegally holding his investments.
Judge Maria Angeles Velázquez said that the plaintiff demonstrated “sufficiently criminal motives” from Binance. Therefore, the plaintiff’s lawyers are given 10 days to submit an official indictment, providing evidence of the guilt of Binance and a request for the payment of a fine. Then Velazquez will decide on the beginning of the official trial with Binance. However, if JL provides not enough evidence, the judge may reject the lawsuit.
Lawyer Chris Criscosa commented on the situation:
“Many lawyers have clients with similar cases: the exchange blocks 67,000 euros, and no one helps the user. If the ban is lifted, Binance will have a hard time in Spain. Without the law on the regulation of cryptocurrencies in the European Union (Mica), this guy could not do anything. The regulation is not talking badly until it is needed, ”Karraskos wrote on the social network Kh.
Recently resumed the investigation of the activities of Binance and the Paris prosecutor’s office. She suspected the exchange in a possible violation of the AML rules, as well as in involvement in tax fraud, drug trafficking and financing terrorism.
