ESEE clarifications for the operation of the stores on the last Sundays of the year
“Based on the official legal data that we currently have at our disposal, the stores will remain closed on December 26, 2021.”
This has been clarified by the Hellenic Confederation of Trade and Entrepreneurship (ESEE) in its circular on the occasion of many questions that, as it announces, it received from commercial associations in view of the preparation of their festive hours.
ESEE with its circular announces, in detail, what applies to the last Sundays of this year:
“Therefore, according to article 16 of law 4177/2013, as in force, the optional operation of commercial stores is provided on 8 designated Sundays per year, including:
– The two Sundays before Christmas.
– The last Sunday of each year.
First of all, as far as the Sundays before Christmas are concerned, there is no problem there and the stores can normally open on the 12th and the 19th of December respectively.
The last Sunday of the year, however, coincides with the 26th of December, the 2nd day of Christmas, which was added to the mandatory holidays under Article 42 of Law 4554/2018. The problem lies in the fact that the Sunday that coincides with a holiday is postponed, according to article 16 of law 4177/2013, only in the cases of the first Sundays of the discounts and not for the other Sundays determined by law.
In this context, the postponement of the last Sunday of the year to another Sunday, when it coincides with an official public holiday, is not allowed, nor is anything different provided in the new framework for public holidays defined by Article 60 of Law 4808/2021.
Therefore, based on the official legal data that we currently have at our disposal, the stores will remain closed on December 26, 2021 “.
