According to Rudakov, most often digital assets are abducted by attackers supposedly providing exchange or investment services. In addition, there are cases of violent seizure of cryptocurrency, up to the abduction of the owners with coercion to transfer passwords for access to cryptocurns.
Affairs of encroachments on crypto assets among the population are considered in many regions of the country. In particular, over the past two years, the courts in Moscow examined seven cases, and four in the Moscow Region. Digital assets regularly appear in cases regarding the illegal trafficking of narcotic substances. In these cases, cryptocurrency is arrested and subsequently confiscated, Rudakov added.
Despite the fact that there are no clear norms of cryptocurrency regulation in the legislation, this does not prevent the courts from making decisions, the judge summed up.
Earlier, Deputy Minister of Justice of Russia Vadim Fedorov announced a bill that will allow security officials and judicial authorities to exclude the emergence of legal conflicts related to the confiscation and arrest of digital assets due to their indefinite legal status.
