‘There is no dismissal for those who do not get vaccinated,’ says Onyx about the ordinance

In an interview with CNN, the Minister of Labor and Welfare, Onyx Lorenzoni, said the RT-PCR test to detect Covid-19 is more reliable than proof of vaccination. The head of ministry defended the examination after the publication of an ordinance prohibiting companies to demand the document in the act of hiring or maintaining the worker’s job.

“The RT-PCR test, from the standpoint of scientific assurance, is much more solid and reliable than the vaccination portfolio,” stated Lorenzoni.

“The test ensures that person does not have the disease.”

After the measure of the Ministry of Labor and Welfare, union centrals released a joint note contesting the government’s decision. The document states that the ordinance “infringes the right to health”.

However, for Lorenzoni, the requirement for proof of vaccination interferes with the employees’ freedom of choice. “The Ministry of Labor has the duty and power to protect the worker against arbitrary or discretionary measures,” said the minister.

“What is being done is a distortion of the collective right, trying to prevent people from having the constitutional right of free choice, of individual freedom, respected.”

Despite the minister’s speech, the ordinance contradicts different decisions and guidelines of the Labor Court, which emphasize the understanding that the health and safety of the community overlap with that of the individual. Thus, the Federal Supreme Court (STF) and the Superior Labor Court (TST) will require the presentation of the vaccine passport when returning to face-to-face activities.
