TIM denies that there is a consortium in the sale of Oi and defends competition

TIM issued a note this Monday (7th) stating that the way the Oi Móvel sales operation was designed preserves the entire Brazilian telecommunications ecosystem.

The statement came after the Federal Public Ministry (MPF) recommended that the Administrative Council for Economic Defense (Cade) disapprove of the purchase of Oi Móvel by TIM, Telefônica/Vivo and Claro due to “competition violations”.

“In this purchase process, there was never any consortium, but three different operations of assets put up for sale due to a judicial recovery accompanied by all the competent authorities, including the state MP”, says the company.

According to the note, TIM is the purchaser of most of the assets and will translate the movement into greater competition and expansion of service levels for all its customers, including those from Oi.

The company argues that the imbalance created through other approved operations is, in fact, the generator of competitive asymmetry that the operation tries to correct.

The telephone company argues that the remedies provided by Anatel, those that will be established by Cade’s Concentration Control Agreement (ACC), the success of the 5G auction and intense sectoral regulation are guarantees of a healthy environment of competition and investments.

TIM also says that the approval of the sale of Oi Mobile enables a large project of a neutral national fiber network, a key input for the plan for the reconstruction and strengthening of telecommunications in Brazil.

Therefore, in the company’s view, the evaluation of the process needs to take into account a wide range of variables, in favor of competition, investments and technological development in the coming decades in a strategic sector for the country.

“A disorderly exit of Oi Móvel from the market will have chaotic consequences for the entire telecommunications system, with negative impacts on competition, consumers and the country’s digital advancement”, concludes the company’s note.
