TJ do Rio sends Henry Borel’s mother back to prison; defense goes to STJ

The judges of the Court of Justice of Rio de Janeiro (TJ-RJ) determined that the mother of the boy Henry Borel returns to prison. The rapporteur of the case considered that the crime judged was too serious for such a decision to be taken.

Monique Medeiros had migrated to house arrest in early April after a decision by Judge Elizabeth Machado Louro, who is leading the case in the criminal court.

The decision responded to a claim by Monique’s lawyers. The judge informed the CNN who has not yet had access to the content of the decision of the 2nd instance and, therefore, could not comment.

The prosecutor in the case, Fábio Vieira, told CNN that compliance with the determination may take days. The decision of the collegiate has not yet been drawn up and would need to go down to the Court of Criminal Executions or to the 1st instance for her to actually be arrested.

Monique’s lawyers told the CNN that in addition to filing a motion for clarification in the TJ itself – a measure that can delay the arrest – they will also appeal to the Superior Court of Justice (STJ). They considered the judges’ decision inappropriate.

Monique Medeiros is accused of triple murder in the death of her son in March 2021. She was arrested a month later and spent a year in jail, where she reported being threatened by other inmates.

The case also involves former Rio de Janeiro councilor Jairo Souza Santos Júnior, Dr. Jairinho. Her ex-partner also claims innocence. Judge Elizabeth Louro has not yet decided whether or not they will go to the popular jury.
