TJSP suspends bidding for the PM to buy 15,000 bulletproof vests

The São Paulo Court suspended the São Paulo Military Police Electronic Auction for the acquisition of 15,000 ballistic vests, after accepting an injunction filed by one of the companies participating in the bidding.

The decision, released this week, points to illegality in requirements of the notice that, according to the judge responsible for the case, restrict the participation of national suppliers.

The auction announcement provided that the vests should have active certification, issued exclusively by US laboratories.

The court understood that, in addition to violating principles such as equality and broad competition, the requirement became unfeasible, as this certification is no longer issued in February 2024 and passes by transition to a new standard.

In the decision, the judge pointed out that there was no technical justification to limit certification to laboratories linked to the US agency, when Brazil already has its own rules for army -controlled products.

For the magistrate, the requirement of the announcement imposes “anticoncorres” barriers and violates the public interest, making it difficult to participate in Brazilian companies.

In a statement, the Military Police stated that “analyzes appropriate judicial measures” and will respond to the decision within the legal deadline.

The corporation also informed that the bidding is to replace salary equipment expected only to the second half of 2026 and, therefore, there is no risk of shortages or impairment to the safety of military police.
