Minister Dias Toffoli, of the Federal Supreme Court, sent a complaint against former Minister of Education Milton Ribeiro for alleged homophobic statements to the Federal Court in the Federal District.
The minister complied with a request from the Attorney General’s Office, which requested that it be sent last week.
“According to the jurisprudence of the Court, the jurisdiction relating to the special forum is only extended if the procedural instruction has already been completed and the parties have been summoned to present final arguments. This is not the case with the case, which is in the process of receiving a complaint, and therefore must be transferred to the first level of the Common Justice”, he said.
The complaint was presented by the Attorney General’s Office itself based on the judgment of the STF, which, by 8 votes to 3, equated the crime of racism with homophobia in Brazil.
The investigation began after an interview with the former education minister in which he linked homosexuality to “disadjusted families” and said that there were teenagers “choosing to be gay”.
In March, the subject of an investigation by the Federal Police and complaints of illegalities involving the distribution of funds from the portfolio, Milton Ribeiro made the position available and lost his privileged forum.
