A decision by Minister Dias Toffoli, of the Federal Supreme Court (STF), suspended the jury in the Kiss Nightclub case, which was scheduled for February 26th.
This Friday's decision (9) is valid until the judgment of an appeal that is in the STF.
The Attorney General's Office (PGR) defended the suspension until the STF analyzes an appeal by the Public Ministry of Rio Grande do Sul (MP-RS) against the annulment of the first jury. The case is confidential at the STF.
The Kiss Boate jury was annulled by the Court of Justice of Rio Grande do Sul (TJ-RS), in August 2022. In September, the Superior Court of Justice (STJ) maintained the annulment.
“With these considerations, I grant the request for a suspensive effect on the extraordinary appeal formalized by the Public Ministry of the State of Rio Grande do Sul, determining, consequently, the suspension of the trial session of the Jury Court scheduled for 02/26/2024 until consideration by this Court of the extraordinary appeals filed”, wrote Toffoli.
