Unanimously, on the afternoon of this Tuesday (6), the Regional Electoral Court of Rio de Janeiro granted the candidacy of federal deputy Marcelo Freixo (PSB) to the state government and councilor César Maia (PSB) as vice on the ticket. .
The Regional Electoral Prosecutor’s Office even filed a challenge against Maia and argued that he had been convicted of administrative improbity by the Federal Regional Court of the 2nd Region, due to problems in the works for the Pan American Games.
In this Tuesday’s session, Maia’s defense pointed out that, as the Prosecutor’s Office itself admitted, the conviction had its effects suspended by the Superior Court of Justice. Therefore, Maia’s political rights are valid.
The rapporteur, judge Alessandra Bilac, followed the defense’s thesis and voted to accept the candidacy in view of the suspension of the conviction for improbity, which could lead to ineligibility.
The rapporteur’s arguments were followed by the entire court, with seven votes to zero for the records of Freixo and Maia.
