The Federal Regional Court of the 1st Region (TRF-1), in Brasília, suspended the effects of the injunction granted by the 2nd Federal Court of Justice of Acre, which obliged the Brazilian Institute of Geography and Statistics (IBGE) to include questions about sexual orientation and gender identity in the 2022 Census.
The decision was made by federal judge José Amílcar Machado, president of the TRF-1, and took place on Friday (24), although it was only released by the federal institute, linked to the structure of the Ministry of Economy, this Monday (27) . The measure took place as part of a public civil action.
In a statement, the agency informed that “the IBGE will only comment on the suspension of the injunction of the Federal Court of Acre, by the TRF-1, after the Attorney General’s Office (AGU) has been summoned and examined the decision. ”, says the positioning.
The IBGE argues in the records that there is not enough time to include the question in the questionnaire of the largest consultation carried out across the country, scheduled to start on August 1st. The magistrate accepted the argument that the measure would compromise the technical parameters adopted for the consultation.
“In short: the present decision is only concerned with the temporal and managerial situation, and the unequivocal serious damage to public, administrative and economic order, which the contested decision would cause”, reads an excerpt from the decision.
The judge, however, reiterated in the text the importance that the demands of the LGBTQIAP+ population are taken into account.
“I note that actions towards equal treatment for the LGBTIA+ population, with the necessary respect that every human being deserves, is no longer debatable. The care and effort of rulers must be broad and consider every citizen, seeking to fulfill their rights and protect their guarantees, which requires its own public policy, due to this minority, without any discrimination”, says another excerpt from the decision. .
The Population Census takes place every ten years and should have been carried out in 2020, but was postponed, first, because of the new coronavirus pandemic. At the time, resources were shifted to the fight against Covid-19. The following year, the consultation was postponed due to lack of resources.
Even after it was decided that the survey would be carried out in 2022, there were intense discussions, judicialized, through an action in the Federal Supreme Court, to guarantee the resources for the census survey.
The dispute had to do with a difference of BRL 300 million: the Union budget had assured BRL 2 billion, but the IBGE pointed out that BRL 2.3 billion would be needed. The government guaranteed the release of the amount to the agency.
