TRF-2 overturns injunction that prevented PRF from acting off highways

The Federal Regional Court of the 2nd Region overturned, this Friday (10), the preliminary (i.e. provisional) decision that prevented the Federal Highway Police (PRF) from acting in off-road safety operations, as in the case of Rio de Janeiro. de Janeiro in Vila Cruzeiro, which resulted in the death of dozens of people in May.

The decision responds to a request made by the Attorney General’s Office, which appealed a decision imposed by the Federal Court of Rio de Janeiro, which had suspended these holdings.

The president of the TRF-2, Messod Azulay Neto, who signed the decision, stated that “from the elements brought to the case, there is no indication of any action by the Federal Highway Police that goes beyond its legal and constitutional mandates”.

“As well highlighted by the Federal Government in its entrance exam, only between March 2020 and March 2022 the joint actions with the PRF, in the state of Rio de Janeiro, exceeded the milestone of 150 operations, with more than 15 security agencies being assisted. different public institutions from the aforementioned member state, with the objective of combating crime, complying with a warrant, preventing slave labor, securing authorities, among other measures”, argued Azulay Neto.

The president of the TRF-2 is one of the names sent by the Superior Court of Justice (STJ) to President Jair Bolsonaro to occupy a ministerial vacancy in the Court. He had 19 votes and was the most voted.Azulay Neto argued, in his decision, that his decision has the objective of “preserving the public interest, preventing the immediate fulfillment of injunctions that could cause serious damage to the legal entity governed by public law and, consequently, to the community”.

“Assuming these premises, I believe that, in the present case, the contested decision has the power to cause serious damage to public order and security”, he added.

The Federal Court in Rio de Janeiro banned the PRF from participating in off-road operations earlier this week, following a request from the Federal Public Ministry.

The decision, in practice, suspended an article in an ordinance of the Ministry of Justice and Public Security that provides that the PRF may “designate staff to integrate teams in the joint operation”.
