A New York appeals court on Tuesday restricted the civil suit of state attorney general Letitia James, who accuses Donald Trump and his family business of “staggering” fraud. All charges against the eldest daughter of the former US president, Ivanka Trump, were also rejected.
In rejecting Trump’s request to dismiss the case, the Division of Appeals in Manhattan said statutes of limitations barred James from processing transactions that occurred before July 13, 2014 or February 6, 2016, depending on the defendant.
The court also explained that all charges against Ivanka Trump must be dismissed because they are too old. The court returned the case to a trial judge to determine which claims should be dismissed.
James accused Donald Trump of lying to creditors and insurers from 2011 to 2021 about the Trump Organization’s asset values, as well as his own net worth, in order to obtain better terms from creditors and insurers.
Opened last September after a three-year investigation, James’ lawsuit seeks at least $250 million in damages and to bar the Trumps from running businesses in New York. The children of the former president, Donald Trump Jr. and Eric Trump, are also defendants.
A spokeswoman for James had no immediate comment. Lawyers for the Trumps did not immediately respond to requests for comment.
Trump, the Republican front-runner for the 2024 presidential election, has called James’s civil case and two unrelated criminal charges he faces, in which he has pleaded not guilty, part of a Democrat “witch hunt”.
