Trump seeks to move NY criminal case to federal court, delay sentencing

Former US President Donald Trump has filed a motion seeking to move his criminal case from New York state to federal court in Manhattan and delay his upcoming sentencing for his conviction on 34 counts of falsifying business records.

The petition filed Thursday (29) asks the federal court to confirm that Trump cannot be sentenced while litigation over removal to federal court is pending.

“These ongoing harms must be stopped. The impending election cannot be redone. The currently unresolved harm to the Presidency resulting from this improper prosecution will adversely affect the operations of the federal government for generations. Accordingly, President Trump respectfully requests that the Court (i) grant this Second Notice of Removal; (ii) confirm that Judge Merchan may not sentence President Trump during the litigation on this Second Notice of Removal because sentencing would result in a prohibited ‘trial of conviction,’” the lawsuit said.

Trump’s sentencing is currently scheduled for September 18, although the CNN previously reported that Judge Juan Merchan is expected to rule in early September on a motion previously filed by Trump’s legal team — which the district attorney’s office did not oppose — to delay until after the election.
