The former president of the United States Donald Trump urged the US Supreme Court today to reject a request by federal prosecutors to immediately consider his claim that cannot be prosecuted for attempting to overturn the outcome of the 2020 presidential election.
It was preceded by special counsel Jack Smith’s emergency request, which if granted would put Trump’s claim before the Supreme Court before a federal appeals court has even ruled on the matter.
Trump’s lawyers point out that the special counsel is urging the Supreme Court to bypass the prescribed process through the Court of Appeals. They also claim that former presidents cannot be found facing criminal prosecution for their actions during their time in the White House.
Judge Tanya Chatkan rejected that claim on December 1, prompting Donald Trump to appeal to a federal appeals court in Washington. On December 11, Special Counsel Jack Smith urged the US Supreme Court to rule on the matter immediately so that the trial does not get delayed.
