Minister Maria Claudia Bucchianeri, from the Superior Electoral Court (TSE), denied a request by the Democratic Labor Party (PDT) for President Jair Bolsonaro (PL) to be prevented from doing electoral propaganda, claiming to have created Pix.
Pix was launched in the current administration, but it began to be prepared in Michel Temer’s government by the Central Bank and disseminated in 2020. The BC’s technical team has autonomy and does not suffer interference from the Executive to carry out its projects.
In the publicity questioned by the PDT and which ran during the mandatory election time, Bolsonaro says that his government created the payment system.
In the decision, the minister stated that judicial intervention on the free market of political ideas must always be exceptional and necessarily punctual.
“The case under examination involves the alleged propagation of disinformation, behavior that violates the “hygidity and integrity of the information environment”, values that justify and legitimize the corrective intervention of the Electoral Justice”, he said.
For the minister, there is no doubt that disinformation and the deconstruction of political figures based on facts known to be untrue or substantially manipulated must be quickly repressed by the Electoral Justice.
“The identification, however, of what can be classified as disinformation content poses significant challenges. I recognize that disinformation is not limited to the dissemination of lies per se, including, equally, the sharing of content with true elements, but seriously decontextualized, edited or manipulated, with a special intention of distorting the disseminated message, with the induction of its recipients in error”.
In the case, according to the minister, the publication does not have “manifestly untrue content that generates serious misinformation, not glimpsing the alleged affront to electoral legislation”.
