TSE denies request to remove post with Lula’s criticism of agribusiness

Minister Maria Claudia Bucchianeri, of the Superior Electoral Court (TSE), denied a request made by the Brasil da Esperança Coalition, by Luiz Inácio Lula da Silva against Eduardo Bolsonaro and others for alleged misinformation in a post that showed an interview in which Lula stated that agribusiness would be rightist and fascist.

Lula’s defense stated that the candidate did not call all agribusiness entrepreneurs fascists. “Actually, what can be seen, from the simple visualization of the full text of the answer offered, is that former President Lula would have referred only to a portion of agribusiness entrepreneurs, notably those uncommitted to preserving the environment”.

The minister stated that she did not find, in the publications questioned, “serious decontextualization that has substantially altered the candidate’s speech, completely subverting it so that it had a completely different meaning, to the point of misleading the voter”.

“The truth is, I believe that the candidate’s speeches, because they are ambiguous and generic, have involved numerous interpretations, to the point of giving rise to a live correction, by the presenter herself, and, after that, a new explanation, now made by the candidate. So much so, that is, so much the candidate’s speech involved numerous readings, that many entities in the agribusiness sector went public to express their nonconformity, which was the subject of journalistic articles by numerous accredited media outlets”, he said.

According to the minister, the questioned posts navigate with comments, criticisms, satires or analyzes within the possible spectrum of meaning of the statements made by the candidate, without any serious decontextualization capable of significantly altering their content, to the point of misleading the voter.

“Furthermore, the way of representation does not lend itself to clearing up misunderstandings, to adjusting any misplaced statements or to giving breadth and visibility to any correction made by the candidate, who will be responsible for neutralizing the criticisms he has suffered or is suffering in the field. of political discourse itself.

For the minister, the TSE’s understanding is that “the fundamental right to freedom of expression is not only aimed at protecting supposedly true, admirable or conventional opinions, but also those that are dubious, exaggerated, reprehensible, satirical, humorous, as well as those not shared by the majority. It should be noted that even erroneous statements are under the protection of this constitutional guarantee”.
