TSE initiates public discussions to improve electoral rules

The Superior Electoral Court starts the cycle of public hearings to discuss and improve the rules that will discipline the 2022 electoral process.

The meetings, which will be virtual because of the pandemic, will continue until Tuesday (23) and will deal with draft resolutions related to next year’s election, such as accountability, advertising and electoral research, auditing, registration of candidacies , general acts and aggregation of results and the regulation of Electoral Observation Missions.

“These hearings aim to gather suggestions to improve the resolutions that will discipline the 2022 Elections. In this way, I emphasize the importance of the cooperation of all those who, directly or indirectly, participate in the electoral process”, said Minister Edson Fachin, vice -president of the Electoral Court.

Public hearings related to election resolutions are mandatory and take place in the second half of the year preceding the elections.

Suggestions for the texts of the draft resolutions must be sent by 23:59 on November 23, through an electronic form and as per prior consultation of the documents made available on the TSE Portal.

After the conclusion of the events, the rapporteurs of the instructions – ministers Edson Fachin and Luís Roberto Barroso –, with the help of the working groups, will examine the contributions received, accepting (or not) the suggestions. Afterwards, the texts will be submitted to the TSE Plenary for approval of the resolutions.

Agenda

On the 22nd, Monday, from 10 am, the minutes on collection and expenditure of resources and accountability in the elections were debated; Special Campaign Financing Fund (FEFC); electoral propaganda, free time and illegal conduct in electoral campaigns; election polls; and inspection and auditing procedures for the electronic voting system.

On the 23rd, also from 10 am, the texts of the drafts on the choice and registration of female candidates for the elections will be discussed; representations, claims and requests for the right of reply provided for in Law 9,504/1997; general acts of the electoral process for the 2022 Elections; and electoral systems, allocation of votes in the total, proclamation of results, diplomas and actions resulting from the electoral process in general and municipal elections.

Still on the 23rd, at 3 pm, the hearing will be about the rules for groups that intend to closely monitor all phases of the election. The so-called Electoral Observation Missions can be formed by entities, civil society organizations or higher education institutions, or even by international, non-governmental organizations, foreign governments and diplomatic missions, among others.
