TSE minister denies PL action against Lula for alleged campaign in PSOL act

Minister Maria Claudia Bucchianeri, of the Superior Electoral Court, denied, this Monday (20), a lawsuit brought by the PL, the party of President Jair Bolsonaro, against the PT because of an alleged advance propaganda that would have been made in favor of the pre-candidacy of Luiz Inácio Lula da Silva for the Presidency of the Republic.

The PL’s action concerns an event organized by the PSOL in which an early campaign in favor of Lula would have been carried out.

The minister denied the action for procedural reasons, precisely because the PL’s action was presented against the PT’s national directory, and not that of the PSOL or the pre-candidate himself.

“In this case, however, the Liberal Party, as said, did not indicate, to compose the passive pole of the present demand, neither those responsible for the acts that it questioned itself, nor even the supposedly beneficiary pre-candidate, limiting itself to to point out, as represented, only the Partido dos Trabalhadores – PT, which was not the organizer of the allegedly irregular event and which had no participation in the factual narrative constructed in the initial petition, thus not being considered as responsible or even as a beneficiary. of the alleged irregularities described by the author”, justified the minister.

For the PL, although the PSOL meeting was held in a “closed environment, typical of a party meeting”, the “act was broadcast over the internet and the video is available to users of the world wide web”.

However, Bucchianeri justified that “the entire narrative of the author [PL]as said, revolves around alleged irregularities carried out in an event held by PSOL (screenshots, speeches by those present, chants sung there), in favor of the pre-candidate Luiz Inácio Lula da Silva, who broadcast the event on his channel on Youtube”.

“Strangely, however, the author indicated, as represented, the Partido dos Trabalhadores – PT, an association completely alien to the narrative developed by him”, he said.

This is not the first time that the PL presents an action with an error in the accused part. At the beginning of the year, the party triggered the TSE against political demonstrations that were held during the Lollapalooza music festival. In the petition, however, the PL included the wrong companies.

Initially, the caption included in the representation the companies Lollapalooza Brasil Serviços de Internet Ltda and Latin Investment Solutions Participações Ltda. After identifying the error, the party submitted a correction to the TSE of the CNPJ of the company responsible for the festival, T4F Entretenimento.
