Turkey’s Supreme Court returns indictment for shutting down pro-Kurdish People’s Democratic Party (HDP) to the prosecutor for procedural reasons, the state news agency Anadolu reported.
The Constitutional Court, according to the APE-MPE, ruled that the indictment had procedural omissions and returned it to the prosecutor, the agency reported.
After completing the necessary details, the prosecutor will have to submit it again to the court. The appellate prosecutor filed an appeal two weeks ago calling for the HDP to be outlawed for alleged links to Kurdish fighters and for a five-year political ban on at least 600 party members.
The prosecutor’s move was the culmination of a long-running crackdown on the HDP, in which thousands of its members have been tried mainly on terrorism charges.
The HDP, the third largest parliamentary party, denies having links to terrorism and called the move a “political coup”. Party officials have said they will reorganize under a new name if outlawed, as Kurdish parties have done in the past when they closed in the long history of party bans in Turkey.
HDP co-chair Mithat Sanjar said earlier today that the indictment “is a disgrace to law and justice”.
“This attack is not just aimed at the HDP and us, it is aimed at destroying the will of the Kurdish people through the HDP. “At the same time, it intends to destroy what is left of democracy and the rule of law in Turkey.”
Turkey’s Western allies have condemned the move to shut down the HDP. President Erdogan’s ruling AK Party and its nationalist MHP allies, who have repeatedly called for the closure of the HDP, have defended the move.
They blamed the HDP for links to the Kurdistan Workers’ Party (PKK), which is considered a terrorist organization by Turkey, the United States and the European Union. The PKK has been waging an armed struggle in predominantly Kurdish southeastern Turkey since 1984, during which at least 40,000 people have been killed.
