Two ministers vote to keep advertising suspension only with Michelle

Ministers Alexandre de Moraes and Maria Claudia Bucchianeri, of the Superior Electoral Court, have already voted to maintain a decision that restricted campaign advertising to the re-election of President Jair Bolsonaro in which the first lady, Michelle Bolsonaro, appears for a longer period than provided for by law. election for candidate supporters.

In Bucchianeri’s decision, given last week, the minister analyzed a request made by the Simone Tebet campaign (MDB). The decision was then taken to the referendum of the virtual plenary of the Court.

In the virtual plenary there is no discussion, only the deposit of votes. The ministers have until this Monday (5) to vote. Ministers Ricardo Lewandowski, Cármen Lúcia, Benedito Gonçalves, Sergio Banhos and Paulo de Tarso Vieira Sanseverino have not yet voted.

In the lawsuit, Tebet’s campaign claimed that the recording is irregular, considering the rules for supporters of candidates who appear in electoral propaganda videos.

According to the minister, that the use of the image of First Lady Michelle Bolsonaro “has the potential to provide unmistakable benefits to the represented candidate, adding to him unquestionable values, so that her position in the material now contested could never be equated with that of a mere presenter, that is, of a person who is limited to lending his voice and image, without, however, any ability to transfer prestige or attributes to one of the candidates in dispute”.

The minister also stated that the limit of 25% of the free electoral time is imposed exclusively on supporters, candidates or not, who come to participate in the program, with the remaining 75% allocated to the different types of advertising languages ​​allowed on the device. , such as characters with proposals, photos, jingles, clips with songs or vignettes and, also, manifestations of the candidate”.
