Two years for exceeding or driving in an oncoming lane without a license: new amendments entered into force in Russia

Today, January 10, amendments to the Criminal Code of Russia came into force, which were officially adopted almost before the New Year. We are talking about a new article under number 264.2, which supplements the Criminal Code and provides for criminal liability for a certain category of traffic offenders. However, it is worth clarifying right away that there is no criminal liability for isolated cases of traffic violations – the addition to the law is aimed at reckless drivers who constantly exceed the speed limit and drive in the opposite lane without worrying about the usual administrative penalties.

This article applies only to those drivers who, after a systematic violation of traffic rules, were deprived of their driver’s license, but after that they were still caught on a similar offense. This means that the driver first needs to get into the hands of the inspector for driving in the opposite lane or exceeding the speed limit by 60-80 km / h, having received an administrative fine, and then again fall into the hands of the authorities under the same article. In this case, the driver should be deprived of his driver’s license, and only if after that he is again caught for driving in the opposite lane or speeding, the reckless driver will be charged with a new article of the Criminal Code.

In this case, the criminal fine will be from 200 to 300 thousand rubles, or the court can choose a punishment in the form of compulsory community service for up to 480 hours. Also, the law provides for punishment in the form of forced labor for up to two years or even imprisonment for a similar period. At the same time, naturally, an amateur to violate traffic rules is deprived of the rights and the opportunity to occupy certain positions or engage in various activities for up to three years. Moreover, the second part of this article even provides for punishment for those who have already been convicted under this article and were again caught for a similar violation – in this case, they can be imprisoned for three years.

Accordingly, citizens who drive carefully and do not violate traffic rules should not be afraid of the new law – it is aimed at repeat offenders who violate laws on an ongoing basis.
