But the changes began on Monday (20), when the president signed a series of executive orders that would give the US immigration and customs service more freedom to perform inspection actions in sensitive areas, expanding the group of immigrants without documents subject to accelerated deportation and end citizenship by birth right.
One of the news is the expansion of the “accelerated removal” procedure to streamline deportations, which aims to include unocuable immigrants anywhere in the United States who cannot prove that they have lived in the country continuously for two years or more.
What is “accelerated removal”?
The rapid deportation procedure, known as “accelerated removal”, allows authorities to expel a person from the country without an audience before an immigration judge.
In doing so, the federal administration expands its powers to deport illegal immigrants.
According to the Non -Government Organization American Immigration Council, foreigners without documents subject to “accelerated removal” procedures have the right to access the asylum system if they express fear of being persecuted or tortured upon returning to their home country.
However, another Trump measure this week was the suspension of flights to refugees planning to travel to the US.
“Since an immigration officer determines that a foreigner is subject to ‘rapid removal’, his removal is ordered,” says the organization.
“Unlike other deportation orders, an order of ‘accelerated removal’ can usually not be appealed and causes a prohibition of reentry of five years in most circumstances,” explained Elizabeth Uribe, lawyer and expert, to CNN.
“The person who has travel documents (as a tourist visa) is subject to the discretion of the immigration agent, because sometimes people come as tourists and stay to work and live and this is not allowed,” he added.
“There are also people who present false documents to be admitted, which is considered fraud, and others who are passing through American citizens, which makes them inadmissible forever,” he concluded.
History of “accelerated expulsion”
“Accelerated Removal” was created in 1996 as part of the illegal immigration reform law and immigrant responsibility.
It would apply to foreigners who arrive without entry documents or try to enter through fraud or forgery, with certain exceptions, says the US Immigration Council.
The organization adds that this legal number can be applied to people who have entered the sea without inspection and have been in the United States for less than two years, and to those who cross an unregistered land border and are arrested within two weeks after their arrival and the less than 160 kilometers from the border.
“Historically, the expulsions occurred on the border when a person was detained trying to enter the country without proper documentation. The immigration officer then used his discretionary power to put the measure into practice, ”explained Uribe.
It pointed out “under the new Trump 2.0 administration, ‘accelerated expulsions’ will also occur inside the country, that is, outside the border. This will apply specifically to non -documented people in the country for less than two years. ”
