The government of USA appealed to the Supreme Court on Monday (18/10) seeking the annulment of the Texas Law on abortions.
The government appealed to the Supreme Court again, which at a previous meeting refused to suspend this law banning abortions when a heartbeat can be detected in the fetus, something that happens around the sixth week of pregnancy, when most women have not even realized they are pregnant.
The government is seeking to overturn a decision by the 5th Circuit Court of Appeals in New Orleans to overturn a lower court ruling that suspended the law. He argues that the decision of the Court of Appeals allows Texas to annul the previous decisions of the Supreme Court and to violate the constitutional rights of its citizens.
“Given the importance and urgency” of these matters, the Supreme Court will have to hear the arguments of both sides and rule without waiting for the lower courts to make their final decisions.
On 1 September the Supreme Court ruled, by a vote of 5 to 4, enforce Texas law, which does not allow abortions even in the case of rape or incest; unless there is an urgent medical need. It also gives citizens the right to sue anyone who has an abortion or helps a woman have an abortion, for a fee. Critics of the law note that this article allows citizens to act as if they were “bounty hunters.”
