The US Justice Department has filed a lawsuit against the state of Idaho over a law banning all abortions after six weeks of pregnancy, saying federal law requires doctors and hospitals to perform abortions that are necessary to save lives.
The lawsuit is the first legal action the Biden administration has taken against states that have restricted access to abortion, following a Supreme Court ruling that struck down the procedure as constitutional.
According to the lawsuit, the federal Emergency Medical Care Act, which requires doctors to perform emergency abortions, trumps state law.
“The lawsuit seeks to invalidate the state’s abortion criminalization of providing abortions to women in medical emergencies,” Attorney General Merrick Garland said at a news conference.
“The message from the Department of Justice today is clear … if a patient comes to the emergency room with a medical condition that threatens their life or health, the hospital must provide the necessary treatment to stabilize that patient,” he added. .
The Justice Department argues in the lawsuit that Idaho “has passed a near-absolute ban on abortion” that “would make it a criminal offense for doctors to comply with the requirement to provide stabilization treatment.”
