The United States Supreme Court on Monday rejected an attempt by an industry group to return with a decision made by the Environmental Protection Agency (EPA) of former President Donald Trump to allow the expansion. sales of gasoline with a higher blend of ethanol, called E15.
The judges’ action was a blow to the ethanol industry, which wants to increase sales and access to E15. Growth Energy, a biofuels industry group that has filed a petition asking judges to review a lower court ruling vacating the Trump administration’s E15 policy, expressed disappointment with the Supreme Court’s decision.
“Growth Energy will continue to explore all potential avenues to make unrestricted access to E15 a reality,” said Emily Skor, the group’s chief executive, in a statement.
The EPA in 2019 extended an exemption that allowed year-round sales of E15, effectively lifting summer restrictions. Acting in a lawsuit brought by an oil refining trade group that contests the policy, the US Court of Appeals for the District of Columbia Circuit ruled last year that the agency had exceeded its authority.
