US Supreme Court suspends deportation’s return order to El Salvador

On Monday (7), the Supreme Court temporarily suspended the deadline imposed by the court for the return of a Maryland man, deported by mistake to El Salvador, accepting President Donald Trump’s request to give more time for both parties to present his arguments.

Supreme Court President Judge John Roberts granted “administrative suspension” on his own, a measure that will extend the deadline until the court issues a more detailed decision – probably within a few days. Roberts deals with emergency cases from the Federal Court of Appeals in Richmond, Virginia.

The decision to temporarily suspend the case, which is relatively common when the court faces a tight deadline, means that Kilmar Armando Abargo Garcia, a salvadored national deported on March 15, will remain for now in an El Salvador prison.

Administrative error

At the end of March, the Trump government admitted that it had deported a Maryland family to El Salvador by mistake.

Kilmar Armando Abrego Garcia, a Salvadoran citizen received status from protected by an immigration judge in 2019, which would prevent the federal government from sending it to El Salvador.

First reported by The Atlantic magazine, the process seems to mark the first time the government has admitted an error related to its recent deportation flights to El Salvador, who are now at the center of a fierce legal battle.
